1. Acceptance of Terms

By accessing and using Mechasm ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, you are not authorized to use the Service.

2. Description of Service

Mechasm provides an AI-powered automated testing platform for web applications. The Service includes but is not limited to:

  • AI-driven test generation from natural language.
  • Automated test execution and self-healing of broken tests.
  • Cloud-based test running infrastructure.
  • Reporting and analytics dashboards.

3. AI Disclaimer & User Responsibility

Important: Our Service utilizes Artificial Intelligence (AI) to generate automated tests.

  • Probabilistic Nature: AI models are probabilistic and may produce inaccurate, incomplete, or unexpected results ("hallucinations").
  • User Verification: You strictly agree that you are responsible for reviewing, testing, and verifying all automated tests and outputs generated by Mechasm before running them in any production or critical environment.
  • No Warranty: We do not warrant that AI-generated tests will catch all bugs or that they will not produce false positives/negatives.

4. User Accounts

To access the Service, you must register for an account (via Google, GitHub, or email). You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property Rights

  • Your Content: You retain ownership of all tests, videos, logs, and application data you upload or generate using the Service ("User Content"). You grant us a worldwide, non-exclusive license to host, copy, and process your User Content solely to provide the Service.
  • Our Property: The Mechasm platform, including its software, AI workflows, algorithms, trademarks, and logos, remains the exclusive property of Mechasm.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Reverse engineer, decompile, or attempt to derive the source code or underlying AI prompts of the Service.
  • Use the Service to build a competitive product.
  • Send automated queries that overwhelm our infrastructure (DDoS).
  • Test applications you do not own or have explicit permission to test.

7. Subscription and Billing

Merchant of Record: Stripe is the authorized reseller and Merchant of Record for your orders.
Fees: Some features are billed on a subscription basis. You agree to pay all fees associated with your plan.
Payment Processing: Payments are processed securely via Stripe. We do not store your full card details.
Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing cycle.

8. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

In no event shall Mechasm, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use or alteration of your transmissions or content.

Total Liability: In no event shall the aggregate liability of Mechasm exceed the greater of one hundred dollars ($100) or the amount you paid Mechasm, if any, in the past twelve (12) months for the Service giving rise to the claim.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these least 30 days' notice prior to any new terms taking effect.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

12. Dispute Resolution

Amicable Resolution: In the event of any controversy or dispute between Mechasm and you arising out of or in connection with your use of the Service, the parties shall attempt, promptly and in good faith, to resolve any such dispute.

Jurisdiction: If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to the competent courts located in Bucharest, Romania.
